Availability of relation ties have obvious basis for doubt in impartiality and separate professional participants criminal and civil processes, including judges. Sometimes practically any determined level of relationship allows to put under doubt the independence and impartiality of judges.

The article analyses the use of the notion "relation" and the notion connected to Azerbaijan legislation. Comparative analysis implementing these notions in Roman law and in some several analogous legislative deeds of Russian Federation and Germany is pursued. The concrete theoretical and practical problems of application of the indicated notions are determined. Some more accurate definitions and changes to current legislation in force in connection with the application of the notion "relation" are offered.
