The idea of lawful state was formulated since old times and counts many centuries, but systematization of this problem and further development was realized by instructors in XVIII century. Accordingly for protection of personal rights and freedom a separate independent individuals create the state, which represents society convention – the result of teh agreement of administrators and subjects. In lawful state the law connects the state, society and individuals. Lawful state principle implicates that each act corresponds to the constitution.
Lawful state ensures supreme justice and law, human rights and freedom maximum guarantees, universal equality, state and society mutual responsibility, human protection and court.
In the article is elucidated lawful state development problems in postsoviet Georgia, transitive period conditions difficulties and resistances of this process.
