The paper deals with the questions of Ottoman state legislation system. This doctrine is different from classical Islamic judicial school. The autor considers these peculiarities and comes to conclusion that reasons why Ottoman legal sistem was not typical one should search in characteristics of Hanefi law school which was wide-spread in the Ottoman Empire. The paper also studies similarity of some aspects of Ottoman and Byzantine justice.
